The Bulgarian Constitutional Court said on Thursday the introduction of a 20%
charge on revenues from wind and solar power generation since January 1, 2014,
was against the law.
The decision was backed by 10 constitutional judges,
the court said in a notice on its website.
The court provided no further
details.
According to the Bulgarian Photovoltaic Association (BPVA), the
adopted decision is an important step towards the stabilization of the energy
sector in Bulgaria and will serve as a positive signal for the investment
climate in the country.
At the end of last year, the parliament decided
to impose the 20% charge, claiming that the proposed fee will have a balancing
effect on the electricity system.
The Bulgarian Photovoltaic Association
and the Bulgarian Wind Energy Association then described the measures as
"discriminatory", adding that they will destroy the small and medium-sized
businesses in the energy sector and will halt the process of diversification of
energy sources in the country with serious consequences for energy
security.
